Proposed Zoning By-law Amendment - PLZACO 2025 059

PURPOSE AND EFFECT OF THE APPLICATION:

The site is located at 70 Vanluven Road (see attached Key Map). The property has an area of approximately 14 acres. The property is currently designated ‘Central Business’ in the Town of Greater Napanee’s Official Plan, and is zoned ‘Arterial Commercial (C2)’ in Zoning By-law Number 02-22.    

The applicant is requesting an amendment to the Zoning By-law to satisfy a condition of provisional approval for consent application PLCOR 2025 041. The amendment will serve to recognize and permit the existing residential use on the provisionally approved severed lands, and apply provisions to manage future development and uses on the lands. The application will also address non-compliance resulting from the severance for the retained lands related to minimum lot frontage and the minimum interior side yard, and apply a holding symbol on the retained lands. The application will have the effect of creating new site-specific C2 zones for the severed and retained lands, respectively.

PUBLIC CONSULTATION:

Anyone may attend the Public Meeting and make a verbal statement, and/or submit comments in writing, either in support or in opposition to the proposed Zoning By-law Amendment. Council will receive a staff report with respect to the applications at the Public Meeting. All representations, both verbal and written, will be considered by Council and make part of the public record, and a staff recommendation for the applications will be submitted to Council for a decision on the matter.

If a person or public body would otherwise have an ability to appeal the decision of the Council of the Town of Greater Napanee to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Greater Napanee before the by-law is passed, the person or public body is not entitled to appeal the decision. If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Town of Greater Napanee before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
