The Council of the Corporation of the Town of Greater Napanee intends to consider a Zoning By-law Amendment to Zoning By-law 02-22. Pursuant to Section 34(12) of the Planning Act (R.S.O. 1990), Council will hold a public meeting on October 26, 2021, to outline the content and effect of the zoning by-law amendment, as well as showing the lands affected. All those interested are hereby invited to attend the public meeting and express their view on the Zoning By-law amendment.


PURPOSE


A Zoning By-law Amendment application (PLZACO 2021 061) was received from Mary and Martin Broeders of 303 County Road 9, acting on behalf of Napanee Brick & Tile Works Ltd. to fulfill a condition of Lot Addition Application PLLA 2021 060. The application seeks to change the zoning of the lands subject to PLLA 2021 060 to rural residential (RR) from Rural Exception Zone 17 (RU-17). The intent of the lot addition application is to address an existing encroachment of an existing detached garage.


EFFECT OF THE ZONING BY-LAW REQUEST


The zoning by-law amendment will permit 170m2 of land to be re-zoned to rural residential (RR) from Rural Exception Zone 17 (RU-17). The re-zoning will change the lands being added to 303 County Road 9 to rural residential (RR) to address an existing garage encroachment.


LOCATION OF PROPERTY


The property is located at 269 County Rd 9. The lands are legally described as Part of Lots 13 & 14, Concession 6 in the geographic Township of North Fredericksburgh, Town of Greater Napanee, as shown on the Key Map.


OTHER APPLICATIONS


The lands are subject to lot addition application PLLA 2021 060.


NOTICE OF APPEAL


If a person or public body would otherwise have an ability to appeal the decision of the Council of the Town of Greater Napanee to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Greater Napanee before the by-law is passed, the person or public body is not entitled to appeal the decision.


If a person or public body does not make oral submissions at a public meeting, or make written submission to the Town of Greater Napanee before the by-law is passed, the
person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal (LPAT) unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

The public meeting will be held at Selby Hall, 114 Pleasant Drive, Napanee ON, October 26, 2021 at 7:00 p.m.
