TOWN OF GREATER NAPANEE ZONING BY-LAW AMENDMENT NOTICE OF COMPLETE APPLICATION AND PUBLIC MEETING

The Council of the Corporation of the Town of Greater Napanee intends to consider a Zoning By-law Amendment to Zoning By-law 02-22. Pursuant to Section 34(12) of the Planning Act (R.S.O. 1990), Council will hold a public meeting on August 17, 2021, to outline the content and effect of the zoning by-law amendment, as well as showing the lands affected.  All those interested are hereby invited to attend the public meeting and express their view on the Zoning By-law amendment.

 

PURPOSE

A Zoning By-law Amendment application (PLZACO 2021 053) was received from Howard Vaughan at 373 Buttermilk Falls Road, Part Lot 7, Concession 7, in the former Township of Richmond to fulfill conditions of Consent Applications PLCOR 2020 062, PLCOR 2020 063, PLCOR 2020 064 and PLCOR 2020 065. The by-law would rezone the retained lot to a site-specific “Rural (RU-X)” zone in order to prohibit the keeping of livestock in the existing barn on the property. The subject site is designated “Rural” in the Official Plan and is zoned Rural (RU) in Zoning By-law 02-22.

 

EFFECT OF THE ZONING BY-LAW REQUEST

The Zoning By-Law Amendment will prohibit the keeping of livestock in the existing barn at 373 Buttermilk Falls Road in order to fulfill a condition of consent applications PLCOR 2020 062, PLCOR 2020 063, PLCOR 2020 064 and PLCOR 2020 065.

 

LOCATION OF PROPERTY

The property is located at 373 Buttermilk Falls Road (north side), legally described as Part of Lot 7, Concession 7 in the former Township of Richmond, now in the Town of Greater Napanee, as shown on the Key Map.

 

OTHER APPLICATIONS

The lands are subject to consent applications PLCOR 2020 062, PLCOR 2020 063, PLCOR 2020 064 and PLCOR 2020 065 that were provisionally approved on March 9, 2021.

 

NOTICE OF APPEAL

If a person or public body would otherwise have an ability to appeal the decision of the Council of the Town of Greater Napanee to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Greater Napanee before the by-law is passed, the person or public body is not entitled to appeal the decision.

 

If a person or public body does not make oral submissions at a public meeting, or make written submission to the Town of Greater Napanee before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal (OLT) unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

 

PUBLIC MEETING PLACE

 

The public meeting will be held virtually on, August 17, 2021 at 7:00 p.m. or shortly thereafter. Written comments are encouraged and will be presented to Council for consideration during the meeting.
