A complete application for Zoning By-law Amendment has been received by the Town of Greater Napanee. Pursuant to Section 34(13) of the Planning Act (R.S.O. 1990), Council will hold a public meeting on October 26th, 2021, to outline the content and effect of the application, as well as showing the lands affected. All those interested are hereby invited to attend the public meeting and express their view on the applications.


PURPOSE


An application was received from Red Tree Development Inc. for a Zoning By-law Amendment (PLZACO 2021 055) to allow for the development of 18 residential units. The application applies to approximately 0.8 hectares as shown on the attached Key Map.


The site is currently designated ‘Medium Density Residential’ in the Town of Greater Napanee Official Plan. Zoning By-law 02-22 places the subject lands in a Residential Type 1 (R1), and Residential Type 4 (R4) Zone.


The subject application would allow for a development of four buildings consisting of 4-unit dwellings and two single detached units for a total of 18 residential units. The development would connect to the existing multi-residential development to the east via a private road connection. The Zoning By-law amendment is proposed to establish site-specific performance standards for the proposed lots and buildings.


EFFECT OF THE ZONING BY-LAW REQUEST


The application will allow for the subject lands to be developed with multi-residential housing in the form of 4 sets of townhouse units which would all contain 4 individual dwelling units and two single detached units.


LOCATION OF PROPERTY


The property is municipally known as 265 Newburgh Road legally described as part of Lots 13 & 14, Part 1 on Plan 29R-598, 1 Plan 29R-6823 Town of Greater Napanee and the County of Lennox and Addington, as shown on the Key Map.

The lands are not subject to any other applications currently.


NOTICE OF APPEAL


If a person or public body would otherwise have an ability to appeal the decision of the Town of Greater Napanee to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Town before the by-law is passed, the person or public body is not entitled to appeal the decision. If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Town of Greater Napanee before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
